Good phone, horrid battery

Battery is only at 52% capacity and dies quickly. I am upset the battery was not replaced with a new one. Everything else was fine but highly disappointed in battery since it was a gift.
Also had dings and markings along edge of phone.
Seller did not indicate that battery needed to be replaced.
