• Yes, this is an apple product. When you start it up, you enter it. But don't worry, you can just create one for free.

• For most of the features, yes. If you have a bunch of movies on your hard drive in an itunes compatible format, you may (or may not) be able to stream them to appletv w/out a itunes account. Itunes accounts are free, the only thing you pay for is rental of movies on the appletv.
