Yes, this radio is under 2W making it an FRS license free radio in the US and legal for use in Canada per their 2W max. The frequencies are open for all FRS and GMRS users with different regulations per channel (the midlandusa.com blog has some really good info on this subject). Wind should not cause you any issues in VOX, you will need to speak into the radio for it to pick up and transmit.
