N O, you must get on their plan to get it for their price. The $99.99 for the phone is a subsidized price for using their service.

If you buy without the contract you looking at price over $400.00 + but you will get the unlock phone which you will be able to use it on T-mobile or AT&T without any contract. Hope that explain a bit.
