“Just purchased the soundbar yesterday. in watching a movie tonight I notice it's quite loud during a lot of scenes but the volume automatically gets considerably quieter on its own during action scenes. Is this normal? Night mode is not on.”

not noticed it getting quite but have noticed that when a commercial comes on i have to turn it down.

You may also want to check the settings on the device that you have connected to the Soundbar. Unfortunately, without knowing more details about what your source is and how you're connected to the device, it cannot be determined if what you are experiencing is normal or if you need to change the settings.
