• Yes, you can buy this device un-activated. However, the price of the phone then goes up to 29.99. Which is only a 5 dollar difference.

• No, until it is activated the wi-fi is not going to work on this phone. A Google search says the phone would have to be active to make and receive calls and send and receive messages over Wi-Fi. ^Daphane
