My purchase from Best Buy appeared to be new. The packaging looked new. The box seal was not broken. Everything inside looked like it was factory packaged. It was no problem to set up, and has been working as expected so far (a couple of months now). Hope this helps.
Sorry, there was a problem. Please try again later.Ours was Brand new in the box. Sometimes Stores sell open box items or Refurbished items, but the box is always marked as such. On the lighter side, I don't care if the box is used as long as the product is new. Hehehe. I do find it strange that a Tivo Supervisor would say that. But if the product had been registered with Tivo at some point, they should be able to tell you that. Love our Tivo!
